ABOUT THE EVENT:

The Crazy Web Game Jam is a game development marathon focused on developing games as a business. Our main goal is to grow the creative economy industry with new games and studios

These Terms and Conditions set out the rules and conditions of participation in the Crazy Web Game Jam 2024 to ensure the success of our event. Further information and guidelines can be found here.

GENERAL PROVISIONS

  1. The Crazy Web Game Jam 2024, including award events (“Event” or “Game Jam”), is co-organized by CrazyGames / MAXFLOW BV based in 3010 Kessel-Lo Ketelmakerij 20, Belgium and co-organized by Indie Hero based in Avenida Treze de Maio, n.º 23, grp 8 salas 1619/1620 – Centro, Rio de Janeiro, Brazil, Brazil (“Organizers”),
  2. Event Duration and Format: The Event will be conducted online between September 2024 and April 2025, as described in the guidelines. All activities, including submissions, communications, and judging, will take place through the designated online platforms. Each participant is responsible for ensuring they have reliable internet access and the necessary technology to participate fully in the Event.
  3. Participation: Participants are invited to register on gamejamplus.com/crazywebgamejam and create a game for the Event (“Game”). Participants must be 18 or older, or represented by their legal guardian, for the award to be delivered. For teams at least one participant must be 18+. The Event is open to participants worldwide unless prohibited by local laws.
  4. Valid Project: A valid project will be considered a project that meets all the following requirements (“Valid Project”):
    1. The Game must adhere to these Terms and Conditions and the Guidelines;
    2. The game must be developed using Unity and be a web game (Unity Web / WebGL) and not exceed 250mb;
    3. The Game must be delivered within the deadlines as communicated by the Organizers;
    4. The Game must have a game build submitted to the CrazyGames developers portal;
    5. The participant must complete the submission with all required info regarding the Game; and
    6. The Game must be suitable for players aged 12+ and must adhere to the PEGI 12 label criteria.

TERMS AND RULES OF PARTICIPATION

  1. Respectful Conduct: Respecting mentors, participants, and organizers is mandatory. Any acts of discrimination regarding gender, color, nationality, sexual orientation, religion, among others, will not be tolerated and may result in disqualification from the Event.
  2. Free Registration: Registration for the Event is free of charge.
  3. Team Representation: It is mandatory to select a person responsible for representing the team, even if there is a subsequent change, when registering on the Event’s official platform.
  4. Team Formation: The Organizers have no restrictions regarding the formation of teams by participants.
  5. Use of Software and Assets: Participants must use Unity (game engine) for their Game.
    1. The Organizers do not restrict the use of ready-made and/or paid assets during
      the Event as long as they are credited.
    2. The Organizers do not restrict the use of graphic materials, audio files, etc.,
      provided participants hold the economic copyright or have obtained the necessary
      licenses to use such materials.
  6. Legal Responsibility: Participants are solely responsible for ensuring that all materials and software used in their Game are legally obtained. The Organizers disclaim responsibility for any legal issues arising from the use of unlicensed or illegal materials or software.
  7. Disqualification: The Organizers reserve the right to disqualify a Game and the participants who created it, especially if the content presented in it:
    1. Violates any applicable law;
    2. Infringes upon another person’s (intellectual) property rights (e.g. plagiarism);
    3. Is inconsistent with fair practice; or
    4. Contradicts the Organizer’s values or Guidelines (e.g., use of hate speech, inappropriate content for the PEGI 12 label, etc.).
  8. Technical Problems: The Organizers will not be responsible for technical problems that arise during the Event and communication failures, or issues that may prevent submissions from being properly received or judged. However, Participants can access a support Discord Channel or FAQ section for assistance with common issues.
  9. Exclusive Development Period: Games must be developed exclusively and entirely during the Event period. Games may be disqualified if premature development is suspected. “Premature development” is defined as any development or creation of game elements (excluding general idea brainstorming and legal use of third party assets during the Event) that occurred before the official start of the Event.
  10. Harmful Code: It is prohibited to implement code or algorithms in the Game that are potentially harmful, invasive, or intended to damage, hijack the operation of, or monitor the use of any hardware, software, or equipment on which the Game is launched.
  11. Time Zone: The start and end of the Event will be based on CET time zone.
  12. Submission Deadlines: The Game must be submitted on the CrazyGames developers portal by 11:59 pm CET on 08/11/2024, and the submission form, including the game preview link, must be submitted on gamejamplus.com/crazywebgamejam2024. The Organizers reserve the right to announce schedule adjustments and postponements if necessary.

SELECTION OF FINALISTS / AWARDS

  1. Prizes: The prizes for the Game Jam consist of the publishing deals offered by CrazyGames as described below. To accept the prizes, the finalists have to enter into a publishing agreement with CrazyGames. Refusal to enter into a publishing agreement means refusal of the prize. The prizes are non-transferable and cannot be changed. The Organizers reserve the right to exchange the prize for a prize of the same value. Any taxes or fees associated with the receipt or use of the prizes are the sole responsibility of the finalists.
  2. Prize Distribution: For teams, the prize will be awarded to the team representative. The representative will be responsible for redistributing the prize among the team members. The Organizers are not responsible for any disputes or claims arising from the distribution of monetary prizes within participating teams. Upon request, the Organizers may assist in distributing prizes directly to team members.
  3. Judging and Announcement: Finalists participants/teams will be announced at the conclusion of the judging period, or as soon as reasonably practicable thereafter. The criteria for determining finalists and the judging process will be outlined in the game jam guide and will be at the sole discretion of the Organizers.
  4. Unclaimed Prizes: If the prize is not collected by the finalist within the stipulated period or if the finalist does not complete the required formalities within the stipulated period, the participant’s right to the prize lapses and the Organizers may award the prize to another participant.
  5. Disqualification for Unfair Practices: Teams and participants found to be in violation of these Terms and Conditions or engaged in unfair practices during the Event, as determined by the Organizers, may be disqualified from prizes.
  6. Incubation and Publishing Deals: Ten selected projects will enter a three-month incubation period, during which they will receive feedback and support from the Organizers, along with an offer for a publishing deal with CrazyGames.

PUBLISHING DEALS

  1. Award of Publishing Deals: Publishing deals will be awarded as follows: $2,500 for 4th to 10th place, $5,000 for 3rd place, $10,000 for 2nd place, and $20,000 for 1st place. These amounts are based on final judging outcomes and participation during the incubation period. The Organizers will have sole discretion over the criteria for selecting finalists and distributing prizes.
  2. Recoupable Advances: The publishing deal amounts are recoupable, meaning they will be recovered from the revenue generated (if any) by the game post-release on CrazyGames’ web-gaming platform. Any earnings beyond the recouped amount will be shared according to the terms outlined in the publishing agreement between the finalist and CrazyGames. Specific details, such as the percentage of revenue used to recoup advances and revenue-sharing models, will be detailed in the publishing agreement.
  3. Welcome bonus: Alongside the publishing deal amounts, all projects that join the incubation program will receive a welcome bonus of $2,500, paid at the signing of the publishing agreement, which is non-recoupable.

INTELLECTUAL PROPERTY

  1. Retention of Rights: The participants will retain any intellectual property rights (including copyrights) in the Games and the Organizers will not claim any intellectual property or any material created by the participants during the Event.

  2. Originality and Ownership: The participant declares that the Game created (or jointly created) by the participant does not infringe any rights of third parties and is the participant’s own creation (or joint creation). The participant will indemnify the Organizers against all possible claims in connection with his/her submitted Game. Games may not incorporate third-party copyrighted or otherwise protected material unless all necessary permissions from rights holders are obtained.

  3. Use for Promotional Purposes: The participant authorizes the Organizers to use materials related to the presentation of the created Game (e.g., screenshots, presentations, or fragments thereof) for promotional or internal business purposes, without time (to the maximum extent permitted by applicable law) or territory limitations and without remuneration, to promote the Game Jam in the current and future versions of the Event and/or similar events. The use will not include monetization or any commercial exploitation of the Game beyond promotion unless a publishing agreement is agreed.

PROCESSING OF PERSONAL DATA

This Privacy Term explains the types of personal data that will be collected, when and how this data will be used, and for what purposes. The provisions in this Privacy Term are subject to continuous improvement and may be updated or modified either unilaterally by the Organizers or as required by law. Participants are encouraged to stay informed of these changes when accessing the Event’s websites and system platforms. We recommend reading this Privacy Term to understand your rights and obligations.

Personal Data and the Purpose of Processing

Data Collected: The personal data collected from participants includes the following:

  1. Name
  2. Email Address
  3. Age of the participant
  4. Discord Username
  5. Country of Residence
  6. Whether the participant knows CrazyGames
  7. Whether the participant has used Unity

This data will be collected to facilitate communication during the Event, manage participation, and tailor the Event experience.

Purpose of Data Collection: The Organizers collect this data for the following purposes:

  • To manage and facilitate participation in the Event.
  • To communicate important Event-related updates and information.
  • To understand participants’ familiarity with CrazyGames and Unity for tailoring event resources and communications.
  • To identify participants and teams for prize distribution and potential future opportunities.


Data Accuracy:
Participants are responsible for the accuracy, completeness, and veracity of the data they provide. If errors are identified in the registered information, the Organizers may contact the participant to request clarifications and/or corrections. Participants are provided with a clear and accessible process for updating or correcting their data. The Organizers will not be responsible for any issues arising from outdated or inaccurate data that the participant fails to correct.

Data Use and Retention: The collected data will be used solely for the purposes outlined above and will be retained only for as long as necessary to fulfill these purposes, including any legal or reporting requirements. Once the data is no longer needed, it will be securely deleted or anonymized, unless further retention is required by law.

Participant Rights: Participants have the right to access their personal data, request corrections, or ask for their data to be deleted, in line with applicable data protection laws (such as GDPR). They also have the right to object to certain types of data processing or request data portability. Requests can be made through the contact details provided on the Event’s platform.

Data Security: The Organizers will implement appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, or destruction. However, participants are advised to take their own precautions in protecting their personal information when interacting with the Event’s online platforms.

Publicity and Promotions: Participants agree that by participating in the Event, if they win a prize and are selected for incubation, their name, country of residence, and Discord username may appear on the Event’s website, other online channels under the editorial responsibility of the Organizers, co-organizers’ websites and online channels, in the written press, and in online broadcasts. This will be done for the purpose of promoting the Event and the participants’ achievements, and participants will not receive any compensation for such uses.

FINAL PROVISIONS

  1. Event Suspension or Withdrawal: The Organizers reserve the right to suspend or withdraw the Event at any time if compelled to do so for legal reasons or due to compelling self-regulatory reasons. In such cases, participants will not be entitled to any compensation or concessions.

  2. Event Modification or Cancellation: The Organizers reserve the right to modify, interrupt, extend, or cancel the Event in case of force majeure or other unforeseen circumstances beyond their control. If such changes are necessary, the Organizers will communicate them to participants as soon as reasonably possible.

  3. Acceptance of Terms and Conditions: By participating in the Event, the participant acknowledges that they have reviewed and fully accepted these Terms and Conditions. Participation implies full acceptance of these Terms, and any participant found to be in violation may be excluded from the Event.

  4. Fraud and Misconduct: Any instance of fraud, cheating, or violation of these Terms and Conditions—including but not limited to the provision of inaccurate personal data, violations of fair practices, or breaches of applicable legal regulations—will give the Organizers the right to exclude the participant from the Event without prior notice.

  5. Governing Law and Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of Belgium. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Belgium.
